Do you set the contractor's working hours or days?Fixed start times, core hours, required attendance at stand-ups.

Has the engagement lasted, or will it last, more than 12 months?Open-ended or repeatedly renewed contracts.

Can they send a substitute to do the work?A genuine, unrestricted right to delegate to someone else.

Do they manage or supervise your employees?Approving leave, running appraisals, assigning work to staff.

Do they carry their own business risk?Own company, own insurance, can make a loss, fixes defective work at their cost.

Why it matters

Reclassification is expensive, and it is usually retroactive

When an authority decides a contractor was in fact an employee, the bill is rarely limited to the future.

Back contributions

Employer social security, pension and health contributions for the whole period, often with interest and penalties. In countries where the employer rate is 30 to 40%, that adds up fast.

Employee entitlements

Paid leave never taken, public holidays, overtime, notice and severance on termination. The contractor can claim these as if they had been employed from day one.

Fines and audits

Many countries fine the hiring company per misclassified person, and a finding usually triggers a wider audit of every other contractor on the books.

Two honest options

Convert to an employee. If the result is High, or Medium and the engagement is long-term, the clean fix is to employ the person.
